Just like the children we serve, Children's is growing quickly and hiring a Staff Counsel to work in-house as part of our legal and compliance/privacy team. This position will work on a wide variety of issues, both in the healthcare field, as well as general corporate matters.   This position reports to the Senior Vice President & General Counsel and works closely with the Assistant General Counsel and Compliance/Privacy Director.

Essential Functions/Competencies

  1. Providing legal analysis regarding health care and corporate matters to support Children's and its affiliated organizations.
  2. Subject matter expertise in the following areas is desirable: EMTALA, 340B, clinical research, HIPAA and data privacy, information technology, reimbursement, licensure, non-profit governance and tax, Medicaid, federal anti-kickback and Stark laws, human resources laws, and intellectual property
  3. Assist with Governance Committee preparation and Audit & Compliance Committee preparation in coordination with the General Counsel
  4. Assist with compliance and privacy reviews as directed by the Compliance/Privacy Director
  5. Demonstrated ability to draft, review and negotiate a wide variety of agreements
  6. Interface with outside counsel regarding depositions, subpoenas and litigation
  7. Develop, implement and review policies, resources and practices to ensure compliance with laws, regulations, and accreditation standards
  8. Stay abreast of regulatory and industry developments in the dynamic healthcare environment and proactively identify potential legal solutions to address risk
  9. Provide timely, concise briefings to the General Counsel, Assistant General Counsel and Compliance/Privacy Director on a variety of issues
  10. Support the Pediatric Research Institute in collaboration with the University of Nebraska Medical Center, with duties including advising the IRB, preparing data use agreements, and assisting with research activities and compliance
  11. Provide support and assistance on human resources related matters and EEOC matters

KNOWLEDGE, SKILLS AND ABILITIES:

  • A proficient understanding of healthcare law, healthcare terminology and principles
  • Interest and experience in corporate law topics, including non-profit law, human resources and benefits issues, and intellectual property

EDUCATION AND EXPERIENCE:

  • J.D. from an accredited law school required
  • Minimum 3 years of relevant health care law experience in corporate, public or private law firm setting
  • Superior academic credentials and 3 or more years of healthcare expertise required

     

CERTIFICATIONS/LICENSURE REQUIREMENTS:

  • Member of the Bar in Nebraska or ability to become licensed in Nebraska within three months of start date
