Description

Primarily responsible for the review and evaluation of the Banks adherence to applicable state and federal laws and regulations pertaining to financial institutions, and the development of policies, procedures, processes, and training supporting compliance/CRA, and addressing compliance issues for the Bank in the areas of mortgage lending, deposits, and consumer lending.

The Compliance Manager functions as an independent and objective body that reviews and evaluates compliance issues/concerns within the organization, and aides in the resolution process. This individual develops and manages all details of the compliance management program, which include planning, organizing and controlling the daily lending and operational activities of the Bank. The Compliance Manager also acts as the Banks CRA Officer and BSA Officer. Working closely with Senior Bank Management, the Compliance Manager is expected to take an active leadership role on various committees and examinations.

 

Major Duties and Responsibilities

COMPLIANCE:

  • Responsible for ensuring the Bank is in compliance with all financial regulations and laws on both a federal and state level, especially with consumer protection laws.
  • Provides Bank management with information to accurately determine the institutions extent of compliance. Schedules meetings with departments and Managers, as necessary, to provide information on compliance changes that affect their departments roles and responsibilities.
  • Advises Senior Management and Bank personnel of emerging compliance issues and consults and guides the Bank in the establishment of controls to mitigate risks.
  • Understands the various business segments and operation products and services, keeping abreast of changes (new products, services or business practices.)
  • Reviews all marketing materials to ensure compliance with all regulations.
  • Evaluates consumer complaints or business practices for trends that require corrective actions.
  • Provides vision, leadership and direction for the Banks compliance program.
  • Develops, administers and monitors policies and programs to ensure the Banks compliance with laws, regulations and rules governing operations and product offerings.
  • Develops, implements and maintains comprehensive compliance program tools that meets regulatory requirements while enhancing organizational performance.
  • Participates in new product development and provides input regarding compliance concerns relevant to proposed and current products and services offered by the Bank.
  • Responsible for receiving satisfactory scores on all compliance exams performed by regulators and third party auditors.
  • Functions as the primary liaison with FDIC and State Examiners, as well as independent auditors. Monitors corrective action of any compliance deficiencies identified in regulatory reports of examination and audit reports.
  • Ensures compliance in the mortgage department by reviewing the Quality Control audits performed by a third party.
  • Provides annual compliance training to all personnel and to the Board of Directors. Teaches instructor-led classes when needed.
  • Implements and monitors internal control procedures.

AUDIT:

  • Develops and monitors a compliance audit program, and performs regular audits to ensure compliance with the Banks established procedures.
  • Develops and monitors the implementation of compliance policies and procedures through the creation and implementation of work plans.
  • Provides recurring reports of compliance risks, issues and resolutions to Executive Management and the Risk Management Committee of the Board of Directors.
  • Follows up on any Audit findings and recommendations.
  • Manages and maintains the Banks CRA program.
  • Acts as Chair of the CRA Committee.

CRA:

  • Responsible for educating bank staff on CRA rules.
  • Maintains a CRA file which depicts the Banks performance as to community development activities, community development loans, donations, investments, and special CRA programs.
  • Updates the Banks CRA public file and CRA statement at offices on at least an annual basis.
  • Monitors the tracking of CRA small business and small farm loan activity.
  • Ensures adherence to all BSA policies and procedures.
  • Reviews periodic reports to ensure compliance with Banks established BSA Program.

BSA:

  • Takes appropriate post-investigation action on unusual customer activity which may include continued monitoring, recommend the filing of a Suspicious Activity Report or other regulatory filing.
  • Models the ACCESSbank core values daily.
  • Develops and maintains a productive working relationship within all departments.

Education and Experience

  • Bachelors degree, preferably in a business related field, or Masters degree in business preferred, and five to ten years of related experience, especially in the area of consumer and mortgage lending.
  • Extensive knowledge of all financial institution policies and procedures.
  • Extensive ability to read, analyze and interpret government regulations, trade journals and legal documents. Must be able to respond to common inquiries from regulatory agencies, courts and outside consultants.
  • Certifications in Compliance, Audit or Risk Management desired. (CRCM, CCBCO, CAMS)
  • Excellent communication skills (written, verbal, listening).
  • Detail-oriented and well-organized, ability to handle multiple priorities and produce results, ability to work independently as well as part of a team.
  • Well-developed verbal/written communication skills and interpersonal skills to be able to interact and communicate with diverse groups of customers, employees, examiners, etc.
  • Proven leadership, relationship, and personnel development skills.
  • Self-motivated/takes initiative.
