REPORTS TO:  Rural Capacity Building Managing Attorney

WORKSITE:  Omaha, Nebraska

POSITION DESCRIPTION:  Nebraska State Court Supervising Attorney is responsible for the provision of direct legal services to immigrant children and families in Nebraska state courts.  The Nebraska State Court Supervising Attorney will establish a standard of practice for ILC attorneys providing representation for juvenile, guardianship, custody, divorce and other state court proceedings related to immigration cases involving Special Immigrant Juvenile Status (SIJ), TVPRA asylum claims, U-visas, T-visas, and other family-based immigration relief options.  The Nebraska State Court Supervising Attorney will work across all ILC legal teams to ensure the consistency and effectiveness of ILC state court representation strategy.

The Nebraska State Court Supervising Attorney will work in partnership with ILC attorneys and a wide variety of other community partners to carry out the ILC mission and objectives of the Rural Capacity Building (RCB) program.  This includes the provision of direct legal services to low-income immigrants throughout Nebraska, focusing on underserved rural communities.  The Nebraska State Court Supervising Attorney will also provide education and advocacy to promote an accurate understanding of state court obligations and limitations for findings or rulings with a related immigration cases. 

This is a full-time position located in Omaha and will oversee RCB Staff Attorneys working throughout the state of Nebraska.  Regular travel to ILC locations in eastern, central, and western Nebraska is required.

MAJOR DUTIES:  

  • Provide legal counsel, advice, and direct representation to ILC clients before Nebraska State Courts.
  • Oversee assigned caseload under the supervision of the RCB Managing Attorney.
  • Collaborate with ILC attorneys in the representation of clients before the Omaha Immigration Court, Board of Immigration Appeals, United States Citizenship and Immigration Services, Immigration and Customs Enforcement.
  • In coordination with the RCB Managing Attorney provide oversight, guidance, and strategic direction for state court cases in multiple jurisdictions across Nebraska.
  • Oversee ILC cases involving the legal needs of clients in the targeted rural communities.  Client legal needs may include both immigration legal services and Nebraska state court proceedings related to immigration cases.
  • Work in collaboration with ILC legal teams and community partners to build capacity and promote inclusion of the immigrant community and advocate for immigrant rights.
  • Work in collaboration with Nebraska Appleseed, Heartland Workers Center, Centro Hispano, Center for Rural Affairs, and Multicultural Coalition to build capacity and promote inclusion of the immigrant community throughout the state of Nebraska
  • Compile and analyze programmatic statistical information for program reports.
  • Lead outreach and education programs related to advocating for the rights of immigrants in state courts.

QUALIFICATIONS:

  • Must have a J.D. and be admitted to practice in Nebraska.
  • Must have 3 – 5 years of state court experience with extensive knowledge of family and juvenile law
  • Ability to work independently, assess priorities, take initiative, handle multiple assignments, and meet deadlines.
  • Willingness to mentor, supervise, and work in collaboration with other attorneys, DOJ representatives, paralegals, and client advocates.
  • Ability to cultivate and maintain relationships with a variety of community stakeholders, particularly in rural communities.
  • Excellent oral, written and analytical skills.
  • Ability to work sensitively with colleagues and clients having diverse personalities, lifestyles, cultures, and faiths.
  • Demonstrated commitment to public interest legal service.
  • Ability to effectively communicate in Spanish is preferred, but not required.
